Welcome to AskIt.fyi. By downloading or using our application from the Mac App Store, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By downloading, installing, or using AskIt.fyi, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our service.

2. Description of Service

AskIt.fyi is a macOS application that provides AI-powered assistance by analyzing your screen content and answering questions. The service includes:

• Screen capture and analysis
• AI-powered question answering
• Customizable themes and settings
• Choice of AI providers (depending on plan)

3. Eligibility and Requirements

3.1 Age Requirement

You must be at least 13 years of age to use AskIt.fyi. If you are under 18, you must have your parent or guardian's permission.

3.2 Mac App Store Account

To purchase and use AskIt.fyi, you need:

• A valid Apple ID
• A compatible Mac running macOS 11.0 or later
• Agreement to Apple's Terms of Service

3.3 No AskIt.fyi Account Required

AskIt.fyi does not require you to create an account with us. All purchases and subscriptions are managed through your Apple ID and the Mac App Store.

4. Subscription Plans and Billing

4.1 Free Trial

New users receive 5 free asks to try the service. No credit card is required for the trial.

4.2 Monthly Subscription

• Price: $12.99/month
• Includes: 300 asks per month
• Billing: Automatically renews monthly unless cancelled
• Cancellation: Cancel anytime; service continues until end of billing period

4.3 BYO API Key

• Price: $39.99 one-time payment
• Includes: Unlimited asks with your own API key
• Supports: OpenAI, Anthropic, OpenRouter, custom providers, and Ollama
• Note: You are responsible for API costs from your chosen provider

4.4 Payment Terms

• All payments are processed through Apple's Mac App Store
• Apple's payment terms and policies apply
• Prices are set in your local currency by the App Store
• Prices are subject to change with notice via the App Store
• Manage subscriptions through Mac App Store Settings → Subscriptions

4.5 Refund Policy

Mac App Store Purchases

Refunds for App Store purchases are handled by Apple.

• Request refunds through reportaproblem.apple.com
• Apple's refund policies and eligibility criteria apply
• Typically eligible for refund within 14 days of purchase
• Contact Apple Support for refund assistance

Direct Download Purchases

We offer a full refund within 7 days of purchase for direct downloads.

• Refund requests must be made within 7 days of the original purchase date
• To request a refund, contact us at help@askit.fyi with your order details
• Refunds will be processed to the original payment method within 5-10 business days
• After 7 days, purchases are final and non-refundable

5. Acceptable Use

5.1 Permitted Use

You may use AskIt.fyi for:

• Personal productivity and assistance
• Educational purposes
• Professional work assistance
• Any lawful purpose

5.2 Prohibited Use

You may NOT:

• Use the service for any illegal activities
• Attempt to reverse engineer or hack the application
• Share your account credentials with others
• Use the service to generate harmful, abusive, or inappropriate content
• Circumvent usage limits or restrictions
• Resell or redistribute the service
• Use automated systems to access the service excessively
• Violate any applicable laws or regulations

6. Intellectual Property

6.1 Our Rights

AskIt.fyi and all related trademarks, logos, and content are owned by us. You may not use our intellectual property without permission.

6.2 Your Content

You retain all rights to your screen captures and questions. We do not claim ownership of your content and do not store it (see our Privacy Policy).

6.3 AI-Generated Content

Content generated by AI providers may be subject to their respective terms and policies. We make no claims to AI-generated responses.

7. Service Availability

7.1 Uptime

We strive to maintain high availability but do not guarantee uninterrupted service. We may experience:

• Scheduled maintenance
• Emergency updates
• Third-party service disruptions

7.2 Modifications

We reserve the right to:

• Modify or discontinue features
• Update the application
• Change pricing with notice

8. Third-Party Services

8.1 AI Providers

AskIt.fyi uses third-party AI providers (OpenAI, Anthropic, etc.). Their terms and policies apply to their services:

• We are not responsible for third-party service availability
• Third-party pricing and terms may change
• BYO API Key users are directly subject to provider terms

8.2 Payment Processing

Payment processing is handled by Apple through the Mac App Store. See Apple's Terms of Service and Privacy Policy for details.

9. Disclaimer of Warranties

ASKIT.FYI IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of AI responses

We do not guarantee that:

• The service will be error-free or uninterrupted
• AI responses will be accurate or reliable
• The service will meet your specific requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASKIT.FYI SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages exceeding the amount you paid in the last 12 months
• Damages arising from AI responses or decisions made based on them

11. Indemnification

You agree to indemnify and hold harmless AskIt.fyi from any claims, damages, or expenses arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws

12. Termination

12.1 By You

You may stop using AskIt.fyi at any time by:

• Cancelling your subscription through Mac App Store Settings → Subscriptions
• Uninstalling the application from your Mac

Uninstalling the app removes all local data and settings from your device.

12.2 By Us

We reserve the right to restrict or terminate your access to the service if:

• You violate these Terms
• You engage in abusive or fraudulent activity
• Required by law or legal process
• The service is discontinued

Since purchases are through the App Store, we cannot directly cancel your subscription—you must do so through Apple.

12.3 Effect of Termination

Upon termination or uninstalling:

• Your access to premium features will cease when subscription expires
• All local app data is removed from your Mac
• Your App Store subscription must be cancelled separately
• Refunds subject to Apple's policies

13. Privacy and Data Protection

Your use of AskIt.fyi is subject to our Privacy Policy, which is incorporated into these Terms by reference. Key points:

• We do not store your screen captures or questions
• Your data is processed in real-time and immediately discarded
• We never use your data to train AI models

14. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by:

• In-app notification when you update the app
• Update notes in the Mac App Store
• Posting on our website

Continued use of the app after changes constitutes acceptance of the new Terms.

15. Dispute Resolution

15.1 Informal Resolution

Before filing any claim, please contact us at help@askit.fyi to resolve the issue informally.

15.2 Arbitration

Any disputes shall be resolved through binding arbitration rather than in court, except:

• Small claims court actions
• Intellectual property disputes

15.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or collective proceedings.

16. Governing Law
